Uninhabitable Property - Asbestos
A residential property was purchased as a second home for £1.95m, paying SDLT of £206,250 on the purchase price. There was an extensive amount of asbestos throughout the property, including specific areas which were assessed to have had an accumulation of asbestos materials with a high risk of being damaged or disturbed. The presence of asbestos stopped NC from making other repairs to the building (including fixing significant rot in the roof and floors which adversely affected the structural integrity of the building) in order to make the property liveable. The issues stemming from the presence of asbestos required partial deconstruction of the property in order to remediate. As such, we argued that the property was not suitable for use as a dwelling, and won a refund of £119,250.
